UAE Gratuity Rules for Resignation vs Termination (2026)

“If I resign, do I lose my gratuity?” This is one of the most searched employment questions in the UAE — and the answer changed completely in 2022. Many websites, HR managers and colleagues still quote the old rules, which cost employees real money. Here is exactly how resignation and termination affect your end-of-service gratuity under the current Labour Law (Federal Decree-Law No. 33 of 2021).

The short answer

Resignation no longer reduces your gratuity. Whether you resign or your employer terminates you, you receive the same calculation:

  • 21 days of basic salary per year for the first 5 years of service
  • 30 days of basic salary per year beyond 5 years

The only universal conditions: you must have completed at least one year of continuous service, and you should serve your notice period properly.

The old rule everyone still remembers

Before February 2022, employees on unlimited contracts who resigned received reduced gratuity:

Service at resignationOld entitlement
1–3 yearsOne-third of gratuity
3–5 yearsTwo-thirds of gratuity
5+ yearsFull gratuity

This reduction was abolished when Federal Decree-Law No. 33 of 2021 came into force on 2 February 2022. All contracts are now limited (fixed-term), and the full 21/30-day calculation applies regardless of who ends the employment. If an HR department applies the old one-third/two-thirds reduction to a resignation today, that is outdated — and worth challenging politely with a reference to the current law.

Resignation: how to leave without losing money

Resigning the right way protects your full entitlement:

  1. Give written notice as per your contract — the law requires between 30 and 90 days.
  2. Work the notice period (or agree a buyout with your employer). Leaving without serving notice can make you liable for compensation in lieu of notice, which the employer may offset against your final settlement.
  3. Complete at least one year. Resigning before your first anniversary means no gratuity at all — if you are at month 10 or 11, it is usually worth waiting.
  4. Get your final settlement in writing and verify it against our UAE Gratuity Calculator before signing any receipt or waiver.

Example: resigning at 4 years

Sana resigns with a basic salary of AED 7,000 after exactly 4 years, serving her 30-day notice.

  • Daily wage: (7,000 × 12) ÷ 365 = AED 230.14
  • Gratuity: 21 × 230.14 × 4 = AED 19,332

Under the old law she would have received only two-thirds of this (about AED 12,888). The 2022 change put roughly AED 6,400 back in her pocket.

Termination: what you are owed

If your employer ends your contract, you receive:

  • Full gratuity for your service period (same 21/30-day formula)
  • Salary for the notice period (worked or paid in lieu)
  • Payment for unused annual leave days
  • Any other contractual dues (commissions, pending reimbursements)

Termination does not reduce gratuity. Even redundancy or company closure leaves your entitlement intact — gratuity is a debt owed to you, and in liquidation cases employee dues rank as priority claims.

The exception: dismissal under Article 44

There is one route by which gratuity-related rights are at risk: summary dismissal for gross misconduct under Article 44 of the Labour Law. An employer may dismiss without notice if, after a written investigation, the employee is found to have committed serious violations such as:

  • Assuming a false identity or submitting forged documents
  • Causing substantial material loss deliberately, or through gross negligence, where the employer reports it within 7 working days
  • Repeated violation of safety instructions despite written warnings
  • Being absent without legitimate reason for more than 20 intermittent days or 7 consecutive days in a year
  • Disclosing work secrets causing loss
  • Being found drunk or under the influence of drugs at work, or committing an assault at the workplace

Even in Article 44 dismissals, the current law’s position on gratuity is far more protective than the old regime — but an employer may pursue deductions for proven losses, and disputes in this area are common. If you are dismissed under Article 44 and believe it is unjustified, file a complaint with MOHRE within the time limits; unlawful dismissal can entitle you to compensation of up to three months’ wages.

Non-renewal of contract

If your limited contract simply reaches its end date and is not renewed — by either side — that is neither resignation nor termination in the penalty sense. You receive your full gratuity for the years served. See our detailed guide on gratuity for limited contracts for renewals and pro-rata calculations.

Frequently asked questions

I resigned and my company says I get one-third gratuity. Is that right? Not under the current law. The one-third/two-thirds reduction applied to unlimited contracts before February 2022 and was abolished. Politely point HR to Federal Decree-Law No. 33 of 2021, and contact MOHRE (600 590000) if they insist.

Does my notice period count towards gratuity? Yes. Your service runs to your last official working day, including a worked notice period.

Can my employer hold my gratuity because I am joining a competitor? No. Non-compete clauses are a separate civil matter — they are not legal grounds for withholding end-of-service dues.

I was terminated during probation. Do I get gratuity? No — gratuity requires one full year of service. Probation termination before a year means no gratuity, though you must still be paid for days worked.

How long does my employer have to pay after my last day? 14 days. After that, you can file a MOHRE complaint.
